8. Product availabilityTop

I. Lead time is dependent on stock availability. Should we have stock available, orders will be dispatched the same day provided payment is validated/received before 1400 hours.

II. Should the product not be in stock please allow 10 working days plus freight transit time. This will allow for manufacturing and delivery to our warehouse.

III. Every effort is made to effect shipment of your order timeously however unforeseen circumstances may cause delays. Should we be faced with such an occurrence, Titanium Man (Pty) Ltd. will contact you via email and provide a revised shipping schedule.

9. Delivery PolicyTop

I. When you click to make a purchase with us, legal obligations arise and your right to refund of monies charged to your credit card or paid in any other way agreed by us, are limited by our terms & conditions. You must not make any purchase through this site unless you understand and agree all our terms and conditions. Once payment is made for the purchase, it is deemed that you have read and understood the terms and conditions for such purchase. If you have any queries, please contact us before making any purchase for any service through this website.

II. Delivery is only available in South Africa. Unless otherwise stated, delivery time for standard deliveries will be approximately two to three business days from confirmation of the contract.

III. After the goods have been handed over to our carrier of choice, you will receive an email with a confirmation of dispatch from Titanium Man indicating the delivery status of your order.

I. All the prices listed on the website exclude value added tax, where applicable.

I. Titanium Man will notify the customer of the delivery charges as well as any additional charges, where applicable, on the order form immediately before the order is placed online. The customer will bear the notified delivery charges and any additional charges as the case may be.

II. Please ensure the correct shipping address is provided from the outset as title and risk will pass to you once the order has left our premises.

12. Undeliverable packagesTop

I. Occasionally packages are returned to us undeliverable. Should this event take place every attempt will be made to contact you to make arrangements for re-shipment.

15.1 Pricing

I. All transactions will be processed in South African Rands (ZAR).

II. Buyer of goods represents and warrants that the credit card information that is supplied is true, correct and complete and charge incurred by the buyer of goods will be honored by the buyer’s credit card company and the buyer shall pay charges incurred by the Buyer at the amounts in effect at the time incurred, including all applicable taxes.

III. Titanium Man (Pty) Ltd. endeavours to offer you competitive prices on current products; your total order price will include the price of the purchase plus any applicable sales tax and shipping charges (on the day of shipping).

IV. Titanium Man (Pty) Ltd. reserves the right to change pricing at any time without prior notice.

V. Titanium Man (Pty) Ltd. reserves the right to exclude certain methods of payment in an individual case or under certain circumstances.

VI. Should Titanium Man (Pty) Ltd. reduce its price on any shipped products within 10 working days of shipment, you may contact us and request a refund of the difference between the price you were charged and the reduced selling price. To receive the refund you must contact us within 14 days of shipment.

I. We accept MasterCard and Visa credit cards. If you do not have a credit card please utilise one of the other payment options, or simply log off and return to the site at a later time to complete your order. All of your order details will be saved online under in the Your Account section available for use whenever you are ready! Apologies for the inconvenience.

15.3 EFT (Electronic Fund Transfer)

I. One of the most widely used ways of sending money online. Once you have added enough items to your shopping cart, proceed to “Checkout” and follow the order processing instructions. 16. Refunds/Returns PolicyTop

I. Should you for any reason wish to cancel your purchase you will be liable for a 15% handling fee. You must advise us in writing of your cancellation and any such cancellation must be signed by the person who made the original purchase. The goods must be returned to us undamaged in the original packaging within 14 calendar days.

* Note: Titanium Man (Pty) Ltd. recommends that you use Speed Services Couriers (South African Postal Services) for all returns as it offers shipment tracking through a 24 hours customer helpline. Should you choose to use a carrier that does not offer a tracking facility and the goods are lost then no refund or return will be considered.

17. Retention of TitleTop

I. Ownership of the goods remains the property of Titanium Man (Pty) Ltd. until the customer has paid the purchase price in full.

II. International customers should make use of a courier that offers:

1. Shipment tracking.

2. Insure your package for safe return and declare the full value of the shipment failing which loss or damage will be for your account.

18. Effects of WithdrawalTop

I. If you withdraw from this contract, we shall reimburse to you all payments received from you with the deduction of the standard 15% handling fee. An official notice must be given to to Company via the contact details provided without undue delay and in any event not later than 14 (fourteen) days from the day on which you received the goods; or if you have not as yet received the goods, from the day on which you notified us of the withdrawal, we will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless we have expressly agreed otherwise with you.

II. Upon withdrawal, should you have taken delivery of the goods so ordered by you, you shall send back the goods or hand them over to us without delay and in any event not later than 14 (fourteen) days from the day on which you received the goods, having regard to the above. The requirements for withdrawal are met if you send back the goods in its original form before the period of 14 (fourteen) days have expired.

19. Exclusion from Right of WithdrawalTop

I. No right of withdrawal shall exist in the case of contracts for the supply of:

A. Non-standard goods made to order on the basis of individual instruction by the customer which are clearly of a personalized nature; and

B. The supply of sealed goods which were unsealed or tampered with after delivery and are thus not suitable for return due to health protection or hygiene reasons.

20. WarrantiesTop

I. Titanium Man warrants that any products supplied by us will be of satisfactory quality, fit for their intended purpose, and will conform to any description given on the Online Store.

21. LiabilitiesTop

I. Great emphasis is placed on quality in the selection of our goods. If the delivered goods show obvious defects, including damage sustained in transit or a manufacturing defect, please raise this issue immediately with us via email (info@titanium-man.co.za) or, if the damage was sustained during transit, immediately inform our delivery carrier.

II. We are fully liable for damage that arises in the following cases: on its merits, for the culpable violation of fundamental contractual obligations, and on its merits for gross culpability of simple vicarious agents, unless Titanium Man (Pty) Ltd can exclude its liability by contract, in accordance with established commercial practice.

III. Liability extends to damage that is typically foreseeable. If contributory negligence of the customer is a factor, then this shall be taken into account

IV. Complaints can only be recognized and processed if proof of purchase is provided.

22. Applicable Law and JurisdictionTop

I. This contract shall be governed exclusively by the laws of the Republic of South Africa.

I. Nothing in these General Terms and Conditions is intended to affect any rights either party may have.
